ATC Conviction Triggers Automatic Disqualification Under Article 63(1)(h)

Islamabad: The members of parliament convicted by the Anti-Terrorism Court have been disqualified with immediate effect under Article 63(1)(h) of the Constitution. According to legal experts and Election Commission sources, such a sentence does not require the ratification or approval of any Speaker or Chairman of the Senate.

Sources say that the disqualifications mentioned in clauses A to P of Article 63 of the Constitution have been divided into two categories. In the first category, a reference or approval from the Speaker or Chairman of the Senate is required for disqualification, while in the second category, the disqualification automatically takes effect as soon as the crime is proven.

According to Election Commission officials, the commission is bound to disqualify these members based on the conviction given by the Anti-Terrorism Court and Section 232 of the Election Act, 2017.
