A key legal point came to light during the hearing of the May 9 GHQ attack case in the Anti-Terrorism Court Rawalpindi, when the court rejected the request for a meeting of lawyers with Imran Khan.
During the hearing, PTI founder Advocate Faisal Malik told the court that a meeting with Imran Khan is essential for an effective defense, however, prosecutor Syed Zaheer Shah took the position that Imran Khan is not in custody in this case but is under the management of the jail authorities.
The prosecutor informed the court that allowing any kind of meeting is beyond the judicial authority and only the jail administration can decide on it.
After hearing the arguments, the court declared that the application regarding the meeting is not admissible, after which the application was rejected.
According to legal experts, this decision could prove to be an important precedent for determining judicial boundaries in similar cases in the future.
