President Asif Ali Zardari has signed the recommendation of Prime Minister Shehbaz Sharif and approved the imposition of emergency and Governor’s Rule in Khyber Pakhtunkhwa. As a result of this decision, the powers of the elected Chief Minister and the provincial cabinet of the province have been abolished, while provincial administrative affairs will be run by the Governor under the instructions of the federal government.
The federal government has taken this step in the context of increasing incidents of terrorism in the province, the law and order situation and differences between the federal and provincial governments on counter-terrorism strategy. According to the official position, extraordinary constitutional measures were necessary due to the threats faced by citizens, security personnel and government installations in the province.
Earlier, a detailed review of the situation in Khyber Pakhtunkhwa was held in a meeting of the federal cabinet chaired by Prime Minister Shehbaz Sharif. The cabinet approved the Prime Minister’s recommendation to the President to use constitutional powers, after which the matter was sent to the Presidency. After the President’s approval, a state of emergency and the imposition of Governor’s rule were announced.
According to the President’s decision, Khyber Pakhtunkhwa Chief Minister Sohail Afridi, provincial ministers, advisors, special assistants and the Advocate General have been removed from their posts. The Governor has been authorized to take over the administrative affairs of the provincial government under the instructions of the federal government.
The federal government maintains that a coordinated strategy and administrative cooperation are essential for effective counter-terrorism operations in Khyber Pakhtunkhwa. The government has also accused the provincial administration of not providing the required cooperation in security matters.
On the other hand, the Pakistan Tehreek-e-Insaf has opposed the emergency and governor’s rule. Chief Minister Sohail Afridi had already declared resistance, calling such a move unconstitutional. The decision is likely to further escalate political tensions between the federal government and the PTI.
It has also been agreed to convene separate sessions of the National Assembly and Senate on October 13. The progress in these sessions will be important on the constitutional requirements of the emergency, parliamentary approval and the future status of the province’s administrative powers.
The decision to impose emergency and Governor’s rule in Khyber Pakhtunkhwa comes after ongoing political and security differences between the federal government and the PTI provincial government. The federal government says that effective measures are needed to combat terrorism and improve law and order in the province, while the PTI has been emphasizing the protection of provincial autonomy and the mandate of the elected government.
Issues of security policy in the province, cooperation with the federal government and PTI’s protest marches have also increased tensions. The federal government has taken a stand to follow the constitutional path, while the PTI has termed such measures as against its political mandate.
Article 232 of the Constitution deals with the imposition of emergency in extraordinary circumstances, while Article 234 deals with the procedure for running provincial affairs in cases where the government in the province cannot be run according to the constitution. The legal implications of these two measures are separate and are subject to constitutional provisions.
Now, the key questions after this decision include the practical structure of the provincial administration, the role of the provincial assembly, the approval process in parliament and the possible reactions of political parties. The progress on these issues in the coming days will determine the direction of the political and administrative situation in Khyber Pakhtunkhwa.
