The main points of the proposed draft of the 27th Constitutional Amendment have come to light, according to which the President will now appoint the Army Chief, Naval Chief and Air Chief on the advice of the Prime Minister, while the post of Chairman Joint Chiefs of Staff Committee will be abolished.
According to the amendment bill, the Prime Minister will appoint the Commander National Strategic Command from the Pakistan Army on the recommendation of the Chief of Defense Forces.
The bill also proposes that officers holding the ranks of Field Marshal, Marshal of the Air Force and Admiral of the Fleet will remain in uniform for life and will also get lifelong privileges.
The amendment also includes a provision that the above positions can be removed only through impeachment by Parliament, while such office-bearers will enjoy judicial immunity like the President.
According to the bill, it has also been proposed to establish a Federal Constitutional Court in which there will be equal representation from all provinces. The Chief Justice and judges of the court will be appointed by the President, and this court will also have the power to review its decisions.
Under the amendment proposals, it has been proposed to abolish Article 184 (suo motu notice), while the power to consult the Supreme Court on law has been transferred to the Constitutional Court.
A judge of the Federal Constitutional Court will be able to serve until the age of 68, while the Chief Justice will retire after completing three years of constitutional tenure.
According to the amendment, the decisions of the Federal Constitutional Court will be binding on all courts, including the Supreme Court, and the Judicial Commission will have the authority to transfer judges.
